Terms of Service

Please read these Terms of Service ("Terms", "ToS") carefully before using the QArtCode.us website (the "Service").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all users and visitors.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you do not have permission to access the Service.

1. Account Registration and Access

  • Google OAuth: To use the Service, you must create an account using your Google login credentials.
  • Account Responsibility: You are responsible for safeguarding your account access and for any activities under your account. You must notify us immediately upon becoming aware of any security breach.
  • Eligibility: You must be at least 13 years old to use the Service.

2. User-Generated Content (UGC) - Photos and QR Codes

The Service allows you to upload photos and other media ("Content") for the purpose of generating custom QR codes.

A. Content Ownership and License
  • Your Ownership: You retain all intellectual property rights in and to any Content you upload. We claim no ownership over your Content.
  • Your Warranty: By uploading Content, you represent and warrant that you are the sole owner or have all necessary rights and permissions for the upload.
  • License to QArtCode.us: You grant QArtCode.us a limited, non-exclusive, worldwide, royalty-free license to use your Content only for the purpose of operating, promoting, and improving the Service (e.g., storing the image, processing it to create the QR code, displaying it in your account).
  • No Public Sharing: We will not share your uploaded Content with other users or the public. Any sharing with third-party vendors (e.g., for printing) will be based solely on your explicit, authorized order.
B. Acceptable Use and Prohibited Content

You agree not to upload any Content that is illegal, threatening, abusive, defamatory, obscene, pornographic, or that infringes on another person's intellectual property or privacy rights. This includes content that promotes hate speech or extreme violence.

We reserve the right, but are not obligated, to remove or refuse to host any Content that, in our sole judgment, violates these Terms or is otherwise harmful or objectionable.

3. Purchases and Fulfillment

Third-Party Fulfillment: You acknowledge that by placing a print order, you are explicitly authorizing us to share your uploaded Content, your generated QR code, and your necessary shipping information with the third-party printing and fulfillment partners we contract with to complete your specific order.

4. Intellectual Property Rights (Our Content)

The Service and its original content, features, and functionality (excluding user-uploaded Content) remain the exclusive property of QArtCode.us.

5. Termination

We may terminate or suspend your account and deny access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. If you wish to terminate your account, you may contact us to request account and data deletion.

6. Disclaimer of Warranties and Limitation of Liability

  • Disclaimer: The Service is provided on an "AS IS"and "AS AVAILABLE" basis. We make no warranties regarding the operation or content of the Service. Your use of the Service is at your sole risk.
  • Limitation of Liability: In no event shall QArtCode.us(the owner/operator of the Service) be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, resulting from:
    • Your inability to use the Service.
    • Any conduct or content of any third party on the Service.
    • Unauthorized access, use, or alteration of your Content or transmissions.

7. Indemnification

You agree to defend, indemnify, and hold harmless QArtCode.us from and against any and all claims, damages, losses, liabilities, and expenses (including attorney's fees) which result from or arise out of your use of the Service or your breach of these Terms, especially any claim that your uploaded Content violates a third party's rights.

8. Governing Law and Changes

  • These Terms shall be governed and construed in accordance with the laws of the State of Georgia.
  • We reserve the right to modify these Terms at any time. We will try to provide at least 30 days notice prior to any major change.
